How bail works in Idaho

Post bail in three simple steps

A bail bond (a surety bond) lets your loved one come home before their hearing. You pay a fraction of the full bond; we guarantee the rest to the court.

Get qualified

Call or start online. A bondsman confirms the bond amount with the Madison County Jail, qualifies you as the indemnitor, and sets up the agreement.

Sign & pay

Documents are e-signed from your phone. Pay the premium on the invoice, or set up a payment plan that fits your budget. No collateral is needed in most cases.

Release

Our local agent posts the bond at Madison County Jail. Release typically follows once the jail finishes processing, often within a few hours.

Idaho specifics

Bond types you'll see

Surety bond — a licensed bail agent posts it. This is what we do.
Cash bail — the full amount paid to the jail or court; call us anyway and we'll help you plan.
Release on own recognizance (OR) — released on a signature, no bond needed.
Property bond — real estate pledged through the court.

FAQ

Teton County bail bond questions

How long until release from Madison County Jail?
Once we post the bond, release depends on how busy booking is. Most releases happen within a few hours. Our agent stays in contact with the jail and keeps you updated.
How much does a bail bond cost?
You pay a premium, typically 10% of the total bond, which is our fee and is not refunded. For example, a $5,000 bond is usually $500. We offer payment plans and don't require collateral in most cases.
Do I have to come to Driggs?
No. Documents are signed electronically from anywhere, payment is handled online or by phone, and our local agent posts the bond at the detention center for you. Out-of-state family members use this every day.
What if bail is set as "cash only"?
Cash-only bail has to be paid in full to the jail or court, so a surety bond can't be used. Call us anyway. We can explain the options, including asking the court to modify the bond at the next hearing.
Which court handles the case?
Misdemeanors and initial appearances are usually in Teton County Magistrate Court (or city court for municipal cases). Felonies go to Teton County District Court (7th Judicial District). Both are listed above with addresses and phone numbers.
What happens if they miss court?
Call us immediately. Often we can help get the person back in front of the judge before a warrant is issued. Missing court can forfeit the bond, so stay in touch with your agent about every date.
